Purpose of the Terms and Conditions of Use

The Terms and Conditions of Use set the framework for the company’s commitment to its members/customers and the terms of the contract between the member (you) and the Thomadakis Company.

By filling out a membership application form and accepting the status of a member (registration form), you acknowledge that you are aware of the following terms and conditions and that all transactions conducted with the company will be subject to these terms and conditions only.

These Terms and Conditions cannot be modified or changed without the written consent of Thomadakis Company. The Terms and Conditions and the policy included therein will apply to every communication, relationship, and transaction between you and Thomadakis Company. Any other Terms and Conditions are expressly excluded.

Members of the COMPANY D. E. Thomadakis & Sons LLC  are encouraged to carefully read these terms of use and use Thomadakis Company’s services through the website www.finefoods.gr only if they fully accept them. Every member of www.finefoods.gr, by registering/using/visiting, is deemed to have acknowledged the terms of use, accepts the terms as outlined here, without exception, and waives any claim arising from their visit to www.finefoods.gr. If any member does not agree with these terms, they must refrain from using the website and engaging in any transaction with it. Your registration as a member implies acceptance of this Agreement and all its terms.

These Terms and Conditions can be modified at any time without prior notice. The current Terms of Use are those in effect at the time of your order. Users of the website are responsible for checking periodically for any modifications to these Terms of Use. Continued use of www.finefoods.gr after any such modification is deemed to be acceptance of the modified terms.

Use of the website www.finefoods.gr by any member – visitor – is at their own exclusive risk. The content of the website www.finefoods.gr does not constitute and cannot be interpreted as providing advice or an inducement for members – visitors to take any action. The evaluation of the content of the website www.finefoods.gr is at the discretion of each member – visitor, who assumes responsibility for the use of any part of it.

Thomadakis Company reserves the right to temporarily or permanently suspend part or all of its services without any prior notice at its sole discretion.

Membership Registration

By accepting these Terms and Conditions and accepting the status of a member in Thomadakis Company, you guarantee that you are over 18 years old and have the legal capacity to form and enter into legal contracts in accordance with applicable law. If you do not meet the required conditions, you should not use our services.

Thomadakis Company is an open purchasing community. To become a member, you must go to the “My Account” section and complete the registration application. Thomadakis Company reserves the right to reject any membership application and also to terminate a member’s participation, without the obligation to provide an explanation.

Becoming a member of Thomadakis Company is free and does not impose any further commitments or obligations.

A member is considered to be an individual who completes the registration process via the registration application, accepting the terms of use.

Reservations

The products sold through our website www.finefoods.gr are exclusively intended for the purchase and personal use of the members. Members are not allowed to resell products purchased from us. Our agreements with suppliers include a clause stating that products sold by us will be made available to members for personal use only and will not be resold. The member is obligated to compensate us for any losses incurred from a violation of this term.

Thomadakis Company makes every effort to present the products on its website as accurately as possible. While we try to avoid errors, in some cases, information on our website may contain inaccuracies or be incomplete. We reserve the right to correct any mistakes or make changes or updates to the website at any time without prior notice. Due to the nature of online product presentation and the various display methods used, colors and fabrics presented on the website may differ slightly from the actual product. If the product does not meet your expectations, you may return it in accordance with our return policy.

Electronic Communication

When you use our website or send us emails, you are communicating with us electronically and consent to receiving communication from us in the same manner. We will communicate with you either via email or, in exceptional cases, by phone. You agree that all agreements, notices, communications, and other types of written communications will be received by you.

Email and Website Communication

You may not use the website for any unlawful purpose or prohibited by these Terms of Use, nor to engage in any illegal activity or any activity that violates the rights of Thomadakis Company or others.

You agree that you will not use the website to post content or other communications that include (a) political or other improper, abusive, illegal, immoral, false, inaccurate, threatening, defamatory, offensive, obscene, violent, defamatory material, or content that encourages criminal acts, (b) advertisements of any type, (c) personal information (such as VAT number, addresses, birth dates, phone numbers, etc.), (d) confidential information about Thomadakis Company or its partners, (e) spam, chain letters, fake emails, contests, or promotional material, (f) messages offering unauthorized use of materials subject to copyright or personal information, and (g) information similar to or related to the above.

Additionally, you agree not to send connection requests on the FINEFOODS.gr website to people you do not know.

Additional Rights and Restrictions:

You should not use this website: a) to send unsolicited commercial emails,
b) to violate any personal or property rights,
c) to present false information belonging to other users or to use a fake email,
d) to impersonate any other person, registered user of this website, or employee of ThomaDakis,
e) to engage in illegal activities,
f) to collect or store personal data and information about other users of this website for any reason,
g) to send, publish, email, or transmit any content that is illegal or for any reason causes illegal damage to ThomaDakis or any third party, or that violates the confidentiality or privacy of any person’s information,
h) to send, publish, email, or transmit any content that offends the users’ morals, social values, minor rights, etc.,
i) to send, publish, email, or transmit any content for which users do not have the right to transmit according to the law or applicable contracts (such as internal information, proprietary and confidential information obtained or disclosed as part of employment relations or under confidentiality agreements),
j) to send, publish, email, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of third parties,
k) to send, publish, email, or transmit any content containing software viruses or other codes, files, or programs designed to interrupt, damage, destroy, or equip the operation of any software or hardware,
l) to intentionally or unintentionally violate any applicable laws or regulations,
m) to harass third parties in any way.

Furthermore, you agree and accept that all members, collaborators, employees, management, shareholders, and other partners of ThomaDakis are not liable for anything that may arise from third-party use of the ThomaDakis website. ThomaDakis is not responsible for any content, as described above, that originates from third parties and is hosted on its website, and under no circumstances can it be considered that ThomaDakis endorses or accepts such content.

ThomaDakis is not responsible for your communication with third-party service providers that may be advertised on its website or for any commercial transaction that may arise from your relationship with them.

Additionally, you agree to indemnify ThomaDakis and its partners for any legal dispute arising between them and third parties due to content you uploaded, posted, or otherwise transmitted through ThomaDakis’ services, as well as in case of inaccurate registration of your details during your registration or updating your information, and generally in case of any breach of these terms of use. Any use contrary to the above, apart from potential civil or criminal penalties, results in the deletion of the content and the termination of the violating member’s account and services without prior notice.

If ThomaDakis is notified that any content causes moral harm or other damage to a third party, it will cooperate with any police or judicial authorities to reveal the identity of the user who posts or transmits such material or information.

Members are obliged to submit complete, correct, and accurate information on the website www.finefoods.gr, to comply with Greek law and especially the telecommunications legislation, to refrain from any illegal and unethical use of the website, and to ensure they do not violate any third-party rights, particularly personal privacy.

In case any member causes technical damage to the website or systems transmitting the website www.finefoods.gr, they are responsible for any damage that results from this damage and must bear the costs of repairing it.

Your Order:

Once you complete and confirm your order online by filling out and submitting the relevant order form on the website www.finefoods.gr, we will confirm your order by sending you an order number via email. The order is only binding once accepted by ThomaDakis with the relevant confirmation email. However, this email does not guarantee that the product is available. If there is a stock shortage, we will contact you within 20 business days from the confirmation email and either offer you a similar product or cancel the order and refund the full purchase price.

Although we make every effort to fulfill your orders, acceptance of an order does not imply its completion. The order is completed with the delivery of the ordered product (or any other agreed-upon product).

To prevent the illegal use of credit cards and other payment options, we will use every possible means to verify that there is no fraud in each order. In any case, we cannot guarantee that we can prevent the illegal use of such information by unauthorized third parties.

The final invoice/receipt will be included with the order when you receive the product (or any other agreed product).

It is advisable to know that your order may be delayed for the following reasons:

• The product has been delayed by our supplier. In this case, we will contact you by phone and/or email to confirm whether you still wish to have the order delivered without this product or if we should propose an alternative. The item will be sent to you once it is received in our warehouses.
• The product has been discontinued and is not available. In this case, we will contact you by phone and/or email to offer an alternative.
• Due to extreme weather conditions, strikes, or force majeure, which may affect the delivery of your order. In this case, we will immediately contact you by phone and/or email to confirm whether you still wish to complete the order under these conditions.
• If we are unable to contact you by phone or email (e.g., due to incorrect or outdated details you provided).

Prices:

The reduced prices displayed on our website are relative to the suggested retail prices given to us by our supplier.

Before placing an order, you declare that you are aware of the following details:

• The listed prices of various products on the website include VAT.
• Any product offers are valid until stocks run out.
• We reserve the right to change prices without prior notice. However, at the time of product receipt, you will pay the price listed at the time of the order.
• ThomaDakis, in good faith, is not responsible and not bound by any errors in product descriptions, images, and prices listed on the website www.finefoods.gr, and cannot guarantee that no errors will occur due to any cause during the entry or update of product details or prices.

Payment:

For deliveries within Greece, ThomaDakis accepts payments via bank transfer or cash on delivery.

Payment should be made at the time of ordering, and if the order is not processed, payment will be refunded (excluding shipping costs paid until the cancellation). The charged amount includes the price of the ordered product as well as shipping costs. If you choose cash on delivery as the payment method, you must pay the courier upon delivery; otherwise, the order will not be delivered.

Product deliveries are handled by cooperating courier companies, to which ThomaDakis sends personal details such as name and delivery address for the delivery and processing of orders.

Regardless of the payment method, the possibility of receiving either a retail receipt or an invoice exists. Invoices are issued to companies and freelancers who fill in the company name, VAT number, tax office, and profession for freelancers during the order.

The invoice/receipt will be sent with your order. If you wish to review your account, please visit our website www.FINEFOODS.gr and check the “My Account” and “My Orders” sections after logging in as a member.

If you choose PayPal as the payment method, a direct credit of your credit card or bank account will be made.

Regardless of the payment method, shipping costs are always borne by the buyer and are paid at the time of ordering.

Payment Security:

Personal information (address, account number, etc.) is encrypted using 128/256bit SSL to prevent unauthorized access or reading of this information. However, we cannot guarantee that our efforts will be successful, as sending confidential information via email services is not the most secure method and carries risks of unauthorized third parties reading the information.

ThomaDakis does not have access to your banking data and does not store any information related to your bank or credit card. Therefore, you are requested to enter your payment details for each order you place with us.

ThomaDakis is not responsible for any damages or losses (direct or indirect) incurred by a member whose card is used illegally or unauthorized.

ThomaDakis is not responsible for any damage that may occur to your computer equipment from viruses, worms, spyware programs, or similar during your connection to our website. Please make sure that you have updated antivirus programs, firewalls, and other computer protection programs.

Delivery / Receipt of Purchases:

Please ensure that the address you enter is correct.
The delivery of your package will take 2-6 business days, although in rare cases, it may take up to 15 days due to our business model and stock availability.
You can track the status of your order at any time in the “My Account” and “My Orders” sections after logging in as a member on our website.

It is preferable to enter a delivery address where someone will be available to receive your order during working hours, such as your workplace. If no one is authorized to receive and sign for the delivery, a note will be left in your mailbox informing you of the incomplete delivery and where you can pick up your package.

If the package is returned to ThomaDakis because it was not collected or because of an incorrect address, the purchase price will be refunded, but not the shipping costs.

If the product is damaged during transportation, please contact ThomaDakis immediately and, if possible, send photos.

Warranty and After-Sales Service:

All products sold through ThomaDakis are covered by the warranty provided by ThomaDakis’ suppliers, ensuring no hidden defects.

To benefit from this warranty, please return the product to ThomaDakis within 14 calendar days of receiving the ordered product, ensuring you include the invoice. ThomaDakis will attempt to replace the product and return it to you. In case of product unavailability, we will offer you either a similar product or a refund of the purchase price.
